Northern Idaho patriot Todd Savage, a real estate broker and owner of Black Rifle Real Estate, recently received a demand letter from his local real estate Multiple Listing Service (MLS) that is affiliated with the National Association of Realtors. The letter stated that using the words “LIBERTY” and “CONSTITUTIONAL” on his ads were ‘racially charge code words’.
In his advertisement, Mr. Savage stated that the property is for “Liberty/Constitutional buyers ONLY.”
Here is a copy of the original verbiage from Mr. Savage’s ad for Black Rifle Real Estate.
MLS demanded that Mr. Savage revise the language used in his listings immediately. Failure to do so will result in the removal of his listings from its website.
According to MLS, “liberty/constitutional buyers” could be a code word for minorities or immigrants because immigrants are not always American citizens and it might result in a lawsuit against them.
Here is an excerpt from the demand letter sent by MLS’ attorney on September 16:
The language at issue states: “This property for sale to Liberty / Constitutional Buyers ONLY.” On its face, the Listings do not violate the FHA. However, the Listsings place MLS at risk of litigation for disparate-treatment or disparate impact under the FHA. The FHA makes it unlawful to, among other things, make unavailable or deny, a dwelling to any person because of race, color, religion, sex, familial status, or national origin. The FHA has been interpreted to prohibit not just intentional discrimination, but also actions that have a discriminatory effect.
Here, there is a risk that “constitutionally based buyers” or “liberty based buyers” could be a code word for minorities or immigrants because immigrants are not always American citizens. The listing itself could be used against the MLS as evidence of the biases. While the listing on its face does not discriminate against a protected class, the legal parameters surrounding disparate impact discrimination and disparate treatment discrimination put the MLS at a risk for a lawsuit.
Based on this risk, MLS demands you modify the Listing language within two business days of the date of this letter. If you refuse to modify the language, your Listings will be removed. I appreciate your prompt attention to this matter.
Mr. Savage released his official statement to the Gateway Pundit regarding the matter where he changed the listing to, “Land for sale to folks that don’t get their feelings hurt”.
“I’m the owner of Black Rifle Real Estate and Flee the City, both firms that focus on helping folks make a strategic relocation to a safer part of the country. With the tyrannical mask and vaccine mandates, many families are seeking a place that honors their beliefs and allows them to home school their children, grow food, and live a sustainable lifestyle.
We use words and terms in our listings on the local MLS such as ‘Liberty’ and ‘Constitutional’ to help prospective buyers find a property that meets their specific criteria. It’s a dark day in America when a local CDA MLS (Multiple Listing Service) affiliated with the National Association of Realtors takes the stance that the words ‘Liberty’ and ‘Constitutional’ may be interpreted as ‘racially charged code words’. This is an example of how the far left implements communist ideology thru Nazi-style stasi tactics in all walks of life. The local MLS has the right to protect their liability by editing what is allowed to be posted by its’ members, this is called freedom, and I honor that. However, I have the right to redress my grievances in a public forum and show the country how ‘Liberty and Constitutionally’ minded real estate brokers are treated by the local MLS. I have complied with the demand letter by changing the listing to simply say “Land for sale to folks that don’t get their feelings hurt”. God Bless America!”
Mr. Savage stated on his website Black Rifle, “THE VERY FOUNDATION OF LIBERTY IS AT STAKE IN OUR COUNTRY.”
He continued:
“Our Founding Fathers shed blood to preserve our God given rights to this amazing land and Black Rifle is here to ensure that such land is in the hands of Patriots. For when the storm arrives we shall prevail, at any cost.”
