Harvard law professor Alan Dershowitz joined Maria Bartiromo on Sunday Morning Futures to discuss Joe Biden’s upcoming Supreme Court pick.

Joe Biden announced earlier this week that his selection to replace Justice Breyer will be a black woman. All others need not apply.

On Sunday Alan Dershowitz argued that this move by Biden is likely unconstitutional.

Alan Dershowitz: I think it may be unconstitutional. If he had said he was going to appoint the first… Muslim to the court, that would be unconstitutional. As the Constitution, Article 6, specifically provides that no religious test should ever be required. I think the 14th and 19th Amendments also extend that to no racial or gender tests. Nobody should ever be excluded because they don’t fit a racial or gender criteria. There are enormous numbers of qualified black judges who would make great appointees to the Supreme Court. And I would applaud if the president picked someone who also fit that criteria. But to announce in advance, no whites, no males apply, brings us back to the when the Supreme Court was exclusively a white male institution.

Neil Young’s Spotify Boycott Over Joe Rogan Sputters As Only Aging Hippie Friends Joni Mitchell and Nils Lofgren Pull Songs

Neil Young’s boycott of streaming service Spotify has so far not garnered much support from his fellow musicians with only aging hippie friends Joni Mitchell and Nils Lofgren announcing they are joining Young by pulling their song catalogue from the platform in protest of the site hosting the Joe Rogan Experience podcast.

Mitchell’s statement: “I’ve decided to remove all my music from Spotify. Irresponsible people are spreading lies that are costing people their lives. I stand in solidarity with Neil Young and the global scientific and medical communities on this issue. —Joni Mitchell”

Mitchell cited a letter to Spotify by activist physicians demanding censorship of Rogan (excerpt):

On Dec. 31, 2021, the Joe Rogan Experience (JRE), a Spotify-exclusive podcast, uploaded a highly controversial episode featuring guest Dr. Robert Malone (#1757). The episode has been criticized for promoting baseless conspiracy theories and the JRE has a concerning history of broadcasting misinformation, particularly regarding the COVID-19 pandemic. By allowing the propagation of false and societally harmful assertions, Spotify is enabling its hosted media to damage public trust in scientific research and sow doubt in the credibility of data-driven guidance offered by medical professionals. JRE #1757 is not the only transgression to occur on the Spotify platform, but a relevant example of the platform’s failure to mitigate the damage it is causing.

We are a coalition of scientists, medical professionals, professors, and science communicators spanning a wide range of fields such as microbiology, immunology, epidemiology, and neuroscience and we are calling on Spotify to take action against the mass-misinformation events which continue to occur on its platform. With an estimated 11 million listeners per episode, JRE is the world’s largest podcast and has tremendous influence. Though Spotify has a responsibility to mitigate the spread of misinformation on its platform, the company presently has no misinformation policy.

Throughout the COVID-19 pandemic, Joe Rogan has repeatedly spread misleading and false claims on his podcast, provoking distrust in science and medicine. He has discouraged vaccination in young people and children, incorrectly claimed that mRNA vaccines are “gene therapy,” promoted off-label use of ivermectin to treat COVID-19 (contrary to FDA warnings), and spread a number of unsubstantiated conspiracy theories…

Lofgren announced, “I stand with Neil Young,” and pulled his songs from Spotify.

Lofgren, who has had a modest solo career for decades but is better known for being a guitarist for Neil Young and Bruce Springsteen, told Rolling Stone, “We encourage all musicians, artists and music lovers everywhere, to stand with us all, and cut ties with Spotify”

In the 1970s, Mitchell wore Blackface, masquerading as a pimp-type character.

The entertainment media tried to fluff Young’s boycott with a disingenuous story on Spotify’s stock losing value when Spotify has been on a deep slide for a year.

In 2006, Neil Young led Crosby, Stills, Nash and Young on the now ironically titled Freedom of Speech tour.

Update: A largely unknown “resistance” group called USA Singers joined the Spotify boycott a few days ago.

Biden Poll Stunner: Only 29 Percent Support Sending US Troops to Eastern Europe in Ukraine Crisis; 76 Percent Reject Pledge to Only Consider Black Woman for Supreme Court

An ABC News/Ipsos poll released Sunday shows Joe Biden has lost support of the American people, including losing a majority of Democrats, on key issues facing the country, most notably rejecting Biden’s pledge to only consider a Black woman for the Supreme Court and Biden sending U.S. troops to Eastern Europe in the Ukraine-Russia crisis. The poll also delivered crushing news for Biden on his handling of the economy with only one percent believing the economy is “excellent” and just 23 percent say the economy is “good”.

George Stephanopoulos reported the bad news for Biden on ABC’s This Week (via Media Research Center):

The poll shows Biden does not have majority support from Democrats for deploying troops to Eastern Europe, his position on only considering a Black woman to replace the retiring Supreme Court Justice Stephen Breyer or on his handling of the economy.

Ipsos headlined their report on the poll: President Biden continues to lose ground with the American public on a range of issues (excerpts):

Americans overwhelmingly believe Joe Biden should “consider all possible nominees” (76%) rather than “consider only nominees who are Black women, as he has pledged to do” (23%). Partisanship drives major differences in attitudes about the next Supreme Court pick, with virtually all Republicans saying “consider all” (95%) compared to only half of Democrats (54%).

…When asked if they would support or oppose “sending U.S. troops into Eastern Europe to try to discourage a Russian invasion of Ukraine”, Americans are split evenly between support (29%), opposition (38%), and indecision (32% don’t know). Democrats are slightly more supportive of U.S. engagement with Ukraine (41% support, 29% oppose) while Republicans are more in opposition (28% support, 46% oppose).

…Only one in four Americans (25%) would describe the nation’s economy as excellent or good. The large majority of Americans (75%) describe the economy as not so good (47%) or poor (28%). Partisanship drives some of the assessment with Democrats split (46% good, 53% not good) vs Republicans very critical (7% good vs 93% not good).

Biden does not have over 50 percent approval on any of the issues polled. He stands at 50 percent approval on his handling of the pandemic and infrastructure. Approval on other issues: Immigration, 34 percent; economic recovery, 42 percent; gun violence, 29 percent; crime, 34 percent; climate change, 47 percent; Ukraine-Russia, 41 percent; inflation, 29 percent.

In addition to asking about Biden’s pledge to only consider Black women for the Supreme Court, the poll asked, “Do you think that U.S. Supreme Court justices rule mainly on the basis of the law or mainly on the basis of their partisan political views?”

38 percent said the justices rule mainly on the basis of law, 43 percent said partisan political views and 18 percent did not know.

Cop-Hating New York Actress Fired After Posting Video Complaining About Streets Blocked Off for Funeral of Slain Police Officer Jason Rivera

A New York actress was fired by her acting company after posting a video complaining about streets being blocked for the funeral of slain New York City police officer Jason Rivera.

Jacqueline Guzman was let go by Face to Face Films according to a statement by the company posted to Facebook.

“Face to Face Films has just been made aware of an insensitive video involving one of our members, Jacqueline Guzman. Face to Face Films does not support nor can condone these comments made about fallen Officer Rivera. As a result, she is no longer a member of our company.”

Guzman originally posted her video to her TikTok account @vinylboobs. She has since reportedly deleted her social media accounts.

“We do not need to shut down most of Lower Manhattan because of one cop died for probably doing his job incorrectly. They kill people who are under twenty-two every single day for no good reason and we don’t shut down the city for them. So, like this is f***ing ridiculous, this is f***ing ridiculous. What if somebody is having a heart attack in this area? Nobody can get to them because it’s all blocked off for one f***ing cop.”

According to a profile, Guzman is originally from Florida.

Rivera was one of two officers shot and killed while responding to a domestic disturbance call on January 21. Thousands of fellow officers turned out for his funeral on Thursday.

A lifelong Democrat voter who enthusiastically supported Joe Biden and Kamala Harris said he is “disgusted with them both” after their first year in office.

“A year in and I’m disgusted with them both. I’m disgusted with Kamala Harris and Joe Biden,” Isaiah Carter, a New York-based Dem voter told Fox News.

“I donated to Biden. I supported Kamala Harris from day one. I even starred in Biden’s victory video ‘America the Beautiful,’” 39-year-old Carter said.

“I did more than I’ve ever done in my entire life for any candidate whatsoever, and I’m disgusted,” he added.

Isaiah Carter said he does not support Critical Race Theory and slammed Joe Biden for his Covid policies and botched Afghanistan withdrawal.

Oregon Court of Appeals Overturns $135K Fine For Bakery That Refused to Make Same-Sex Wedding Cake

The Oregon Court of Appeals has overturned a $135,000 fine imposed on a bakery that refused to bake a wedding cake for a same-sex couple in 2013.

The court upheld the 2017 ruling against Aaron and Melissa Klein, who owned a bakery called Sweetcakes by Melissa, but scrapped the fine.

Local station KOIN reports:

In an opinion released Wednesday, Jan. 26, the court upheld its original 2017 decision against the couple — Aaron and Melissa Klein, then doing business as Sweetcakes by Melissa — based on a 2015 determination by the Bureau of Labor and Industries that they violated Oregon’s 2007 law barring discrimination based on sexual orientation. The couple argued that doing so would infringe on their religious rights.

But the court also overturned its previous approval of $60,000 in noneconomic damages to Laurel Bowman-Cryer and $75,000 to Rachel Bowman-Cryer, both awarded by an administrative law judge in the bureau. The court found that the awards were based partly on a conversation about beliefs between Aaron Klein and Cheryl McPherson, Rachel’s mother, who the court found relayed it inaccurately to the couple.

The Klein’s had argued that they refused to bake cakes for same-sex weddings due to their religious beliefs. They ended up closing their business in 2016 amid the legal battle.

A lawyer representing the Kleins said that they will continue to fight by appealing again in the Oregon Supreme Court, and possibly the U.S. Supreme Court, because “they failed to prevail on the issue of religious beliefs.”

Stephanie Taub is senior counsel for First Liberty Institute, which represented the Kleins, said in a statement that they were the victims of “anti-Christian bias.”

“Oregon is trying to have its cake and eat it, too. The court admits the state agency that acted as both prosecutor and judge, in this case, was biased against the Kleins’ faith. Yet, despite this anti-Christian bias that infected the whole case, the court is sending the case back to the very same agency for a do-over. Today’s opinion should have been the end of this 10-year-long saga. It’s time for the state of Oregon’s hostility toward Aaron and Melissa to end,” Taub said.

CNN cannot compete with Joe Rogan’s podcast so like the true Communists they are, they are calling for Rogan to be cancelled.

It’s not enough for the Cosmopolitan elitist snobs on the CNN panel to attack Rogan, so now they’re attacking Rogan’s millions of listeners.

Joe Rogan has a huge audience because people enjoy hearing different opinions.

The knives are now out for Rogan because he has invited guests such as Dr. Malone to appear on his podcast to discuss the dangers of the Covid mRNA gene therapy vaccines.

CNN’s talking potato Brian Stelter and his creepy sidekick Oliver Darcy compared Rogan’s listeners to people who make bad diet choices and eat too many Doritos.

Writer Kat Rosenfield chimed in and said Rogan’s listeners are just a bunch of rubes who aren’t enlightened.

“Here is people who, they like something that we — you know, who consider ourselves more enlightened — don’t think is good for them, we think that they’re internalizing this misinformation and using it to make bad decisions …” Rosenfield said.

Murthy complained that social media companies are not doing enough to ‘stop the spread’ of Covid misinformation before calling on Spotify to silence Joe Rogan.

White House Confirms Name of Judge They Are Considering for Supreme Court

The White House has confirmed that they are considering South Carolina District Court Judge Michelle Childs to fill Justice Stephen Breyer’s seat on the Supreme Court.

Childs is, as promised by Biden, a black woman.

“Judge Childs is among multiple individuals under consideration for the Supreme Court, and we are not going to move her nomination on the Court of Appeals while the President is considering her for this vacancy,” White House Deputy Press Secretary Andrew Bates said in a statement, obtained by Fox News. “At the same time, reporting indicating that the President is only seriously considering three potential nominees is incorrect.”

The report added that “Childs had been scheduled to appear at a hearing on Capitol Hill on Tuesday as part of the confirmation process for the Washington, D.C. Circuit Court of Appeals for which Biden nominated her in December.”

House Majority Whip James Clyburn, who pressured Joe Biden to nominate a black woman to the court before endorsing him during the 2020 election, has expressed support for Childs. He also said that he has been lobbying for her nomination with “the president and his people.”

“Now, as it relates to who, I don’t have anything against the seven or eight names that I have been floated as possibilities, the all great people,” Clyburn, who represents South Carolina’s 6th congressional district, told the Washington Post. “The fact of the matter is, I have been discussing Michelle Childs with the president and his people now for, I guess at least 13 months now.”

Biden has said that he intends to announce his official nominee by the end of February.

On Thursday, Biden once again affirmed that he intends to nominate a black woman.

“Our process is going to be rigorous. I will select a nominee worthy of Justice Breyer’s legacy of excellence and decency,” Biden said. “While I’ve been studying candidates’ backgrounds and writings, I’ve made no decision except one: The person I will nominate will be someone with extraordinary qualifications, character, experience and integrity. And that person will be the first Black woman ever nominated to the United States Supreme Court.”

Federal Judge Blocks Texas Anti-BDS Law Being Enforced on Palestinian-American Contractor

A federal judge has blocked a Texas law being enforced against a Palestinian-American contractor that prohibits government agencies from doing business with companies that participated in the boycott, divestment and sanctions (BDS) efforts against Israel.

The judge ruled that the law infringed on the contractor’s First Amendment rights.

The lawsuit was filed by A&R Engineering and Testing Inc. which is owned by a Palestinian-American named Rasmy Hassouna.

“Texas’s ban on contracting with any boycotter of Israel constitutes viewpoint discrimination that chills constitutionally protected political advocacy in support of Palestine,” A&R Engineering attorneys wrote in the complaint.

Hassouna’s company had worked with the city of Houston for 17 years, but refused to renew his contract over the anti-BDS law.

“The speech contemplated by [Rasmy’s company] may make some individuals — especially those who identify with Israel — uncomfortable, anxious, or even angry,” U.S. District Court Judge Andrew Hanen wrote. “Nevertheless, speech — even speech that upsets other segments of the population — is protected by the First Amendment unless it escalates into violence and misconduct.”

Judge Hanen added: “The Court does find that Hassouna authentically holds a pro-Palestinian point of view that is protected by the First Amendment.”

Hassouna was represented by the Council on American-Islamic Relations (CAIR), who celebrated their victory in a press release.

The injunction currently only applies to Hassouna.

“This is a major victory of the First Amendment against Texas’s repeated attempts to suppress speech in support of Palestine,” said CAIR Senior Litigation Attorney Gadeir Abbas. “These regressive attempts to create a Palestine-exception to the First Amendment betray the central role boycotts have played in our history.”
